Why Arbitration?
Arbitration is generally considered preferable to a trial because arbitration procedures are more flexible. This flexibility can result in significant cost savings arising from more limited investment in time and expense. Further, since the parties can choose their own arbitrator, and generally select someone with a certain amount of experience in the subject matter, they may have more confidence that the adjudication will result in an accurate and/or fair award. The arbitration process is also more private and confidential than a trial, in that the arbitration is not held in a public forum. The arbitration is usually held in a private conference room. The parties can enter into a contract agreeing to keep matters confidential, and since no jury is present, participants can limit the number of people exposed to the evidence.
